1. Acceptance of Terms

By downloading, installing, or using the Crusd application ("App") or accessing the Crusd website at crusd.io ("Website"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legal agreement between you and Ammar Software B.V. ("Crusd," "we," "us," or "our"), a private limited company (besloten vennootschap) registered in the Netherlands under Chamber of Commerce (KvK) number 91771757, which operates the App and the Website. If you do not agree to these Terms, do not use the App or Website.

2. Description of Service

Crusd is an iOS application that provides structured training plans for running, strength, and conditioning. The App offers workout tracking, training load analysis, Apple Watch integration, calendar sync, and optional readiness-based workout adaptation through health data analysis.

3. Eligibility

You must be at least 13 years of age to use Crusd. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Health & Fitness Disclaimer

Crusd is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult a physician or qualified healthcare provider before beginning any exercise program, particularly if you have any pre-existing medical conditions, injuries, or health concerns.

The readiness scores, adaptive insights, training recommendations, and recovery suggestions provided by Crusd are generated algorithmically based on available health data (including heart rate variability, resting heart rate, sleep analysis, and training load). These outputs should not be considered medical advice and are not a substitute for professional medical judgment.

You acknowledge and agree that:

  • Physical exercise carries inherent risks, including but not limited to risk of physical injury, disability, and death, and you voluntarily assume all such risks associated with your use of the App.
  • Crusd does not guarantee any specific fitness outcomes, performance improvements, or health results.
  • You are solely responsible for determining whether any training plan, workout, or recommendation provided by the App is appropriate for your individual fitness level, health status, and circumstances.
  • If you experience any pain, discomfort, dizziness, or other symptoms during exercise, you should stop immediately and consult a healthcare provider.
  • The training plans provided by Crusd are general fitness programs and are not customized medical prescriptions.

5. Accounts & Subscriptions

Free Plan

Crusd offers a free tier that includes access to novice-level running plans (5K through 10K), all strength training plans, novice conditioning, workout tracking, HealthKit dashboard integration, calendar sync, Apple Watch scheduling, and streak tracking. The free tier is limited to one active training plan at a time.

Crusd Pro

Crusd Pro is a premium subscription available as:

  • Monthly: $4.99 per month
  • Yearly: $34.99 per year

Pro features include all plan levels and distances, multiple active plans, daily readiness scores, adaptive workout insights, smart postponement with auto-rescheduling, and recovery recommendations.

Billing & Renewal

All subscriptions are processed through Apple In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Free Trials

If offered, free trial periods automatically convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial expires. Any unused portion of a free trial is forfeited when you purchase a subscription.

Cancellation

You may cancel your subscription at any time through your Apple ID subscription settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except as required by applicable law or Apple's refund policies.

6. Intellectual Property

All content within the App, including but not limited to training plans, workout algorithms, readiness scoring methodology, user interface design, graphics, and text, is the intellectual property of Crusd and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, reverse engineer, decompile, or create derivative works based on the App or any of its content without prior written consent.

7. Third-Party Trademarks

Crusd is not affiliated with, endorsed by, or sponsored by any third-party fitness brand, event organizer, or competition. Any references to third-party names, brands, events, or competitions (including but not limited to Hyrox, Apple, Apple Watch, and HealthKit) are used solely for descriptive and informational purposes to indicate compatibility or the type of training the App may help you prepare for.

All third-party trademarks, service marks, trade names, and logos are the property of their respective owners. Their use on the App or Website does not imply any affiliation, endorsement, or sponsorship.

8. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Use automated means to access or interact with the App.
  • Interfere with or disrupt the integrity or performance of the App.
  • Attempt to gain unauthorized access to any systems or data associated with the App.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

10. Third-Party Services

Crusd integrates with the following Apple services, each governed by their own terms:

  • Apple HealthKit: Used to read health data (with your permission) for activity summaries and readiness calculations.
  • iCloud/CloudKit: Used to sync your workout data, training plans, and progress across your devices.
  • Apple Watch/WorkoutKit: Used to schedule workouts to the Workout app on Apple Watch.
  • iOS Calendar/EventKit: Used to sync planned workouts to your calendar.

Crusd is not responsible for the availability, accuracy, or functionality of these third-party services. Your use of these services is subject to Apple's terms and conditions.

11. Apple-Specific Terms

These Terms are between you and Crusd, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Crusd does not warrant that the App will be uninterrupted, error-free, or completely secure. Crusd does not warrant the accuracy, reliability, or completeness of any readiness scores, training recommendations, health data analysis, or other content provided through the App.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRUSD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

CRUSD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO CRUSD IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, CRUSD'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless Crusd and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another.

15. Modifications to Terms

Crusd reserves the right to modify these Terms at any time. Material changes will be communicated through the App or Website. Your continued use of the App after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

16. Termination

Crusd may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands — except where mandatory consumer-protection law in your country of residence entitles you to bring proceedings there.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Crusd regarding the use of the App and supersede any prior agreements.
